The Fiscalia (prosecution service) of Spain have asked that the Justices postpone the continuing appeal of Arnaldo Ortegi.

Arnaldo Ortegi is the spokesman for the Basque Nationalist Party Batasuna that has been banned in the member states of the European Union. It has been illegal since 2003. On April 26 2007 he was sentenced to prison for glorifying terrorism. Ortegi supports ETA.

The Fiscalia has asked that the interrogation of Otegi wait until the situation of another two accused Jon Salaberria and Araitz Zubimendi who are at liberty is known. In a note presented to the Quarter session of the court accusations were given that the ETA suspects knew of the explosives being handled by a third man which led to his death.

Otegi faces appeal at the Supreme Court against a 15-month conviction for defending terrorism. He has previously spent four years in jail for kidnapping.
